1. Introduction
1.1
This privacy policy (the “Policy”) describes how Ahya, its affiliates, and subsidiaries (“Ahya”, “we”, “us”, or “our”) collect, process, use and disclose Personal Information (as defined below).

For the purposes of this Policy, "you" refers to any individual (including individuals associated with an entity) that:
1.
visits or browses our website or provides us with information (such as contact details or inquiries); and
2.
uses, or is interested in, our products and services offered by Ahya.
1.3
For the purposes of this Policy, the term Personal Information includes personally identifiable information that can be used to contact or identify an individual (“Personal Information”) or has the same meaning as the terms “personal information”, “personal data”, “personally identifiable information”, or the nearest equivalent term or concept under the applicable data privacy laws.
1.4
For the purpose of this Policy, “processing” includes any operation or set of operations that are performed on information or on sets of information, whether or not by automated means, including, for example, collection, use or disclosure of information, and the terms “process” and “processed” shall be construed accordingly.

This Policy does not apply to any of the Personal Information that we process on behalf of our customers through their use of our products and services (“Customer Data”). Our customers’ respective privacy policies govern their collection and use of Customer Data. Our processing of Customer Data is governed by the contracts that we have in place with our customers and not this Policy except insofar as this Policy or any provisions thereof are incorporated into such contracts.
2. Data We Collect
2.1
Data you provide to us directly: When you use our products and services, contact us (including via social media), participate in an online survey conducted by us, or otherwise interact with us, we may collect a variety of information about you / individuals associated with your organization including:

Account creation: When you create a user account to avail our products and services, we collect your name, organization name, email address, and country of operation.
2.
Purchases: We may collect information and details associated with your purchases, including payment information. Any payments made via our products and services are processed by third-party payment processors. We do not directly collect or store any payment card information entered through our products and services, but we may receive information associated with your payment card information (e.g., your billing details).
3.
Communication with us: When you request information about our products and services, sign up for a newsletter, or otherwise communicate with us, we may collect Personal Information from you such as name, email address, phone number, or mailing address.
4.
Customer service and support: If you call or otherwise interact with our customer service and support, we may collect the information you provide to our representatives. In addition, we may record audio conferencing between you and our representatives for training and quality assurance purposes.

Interactive features: We may offer interactive features such as commenting functionalities, forums, chat services, and social media pages. We may collect the information you submit or make available through these interactive features. Any information shared on the public sections of these channels will be considered “public” and may not be subject to the privacy protections referenced herein.

Conferences, trade shows, and other events: We may attend conferences, trade shows, and other events where we collect Personal Information from individuals who interact with or express an interest in us and/or our products and services (including name, email address, phone number, mailing address, and photographs). If you provide us with any information at one of these events, we will use it for the purposes for which it was collected.

Surveys: We may contact you to participate in surveys. If you decide to participate, you may be asked to provide certain information which may include Personal Information.

Business development and strategic partnerships: We may collect Personal Information from individuals and third parties to assess and pursue potential business opportunities.

Other purposes: We may collect Personal Information for other purposes relating to the business operation and management of the Company and/or the group. For example, to publish your names, pictures, articles, and other Personal Information via Ahya’s internal communication channels or on social media.
2.2. Data Collected Automatically
2.2.1
Device data: When you use our products and services by or through a web or mobile-based device, we may collect certain information automatically, including, but not limited to, the type of device you use, your device unique identifier, the internet protocol (IP) address of your device, device operating system, the type of browser you use, your interaction with our products and services via server log files, and other diagnostic data.
2.2.2
Tracking technologies and cookies: We also collect information automatically through a variety of technologies, as provided below:
a.
A pixel tag (also known as a web beacon) is a piece of code embedded on our products and services that collects information about users’ engagement. This may include information that your browser sends whenever you visit our website, such as your computer’s IP address, browser type, browser version, location data, the pages of the website that you visit, the time and date of your visit, the time spent on those pages, and other usage statistics. We may also include web beacons in e-mails to understand whether messages have been opened, acted on, or forwarded.

Strictly necessary cookies: These cookies are necessary for the functioning of the website. In general, these cookies are only set in response to actions you take in response to a service request, such as setting your privacy preferences, logging in, or filling out forms. You can set your browser to block these cookies or to notify you about these cookies. However, some areas of the website may not function properly.

Performance cookies: These cookies enable us to count visits and traffic sources so that we can measure and improve the performance of our website. They help us answer questions about which pages are most popular, which are least used, and how visitors move around the site. All information collected by these cookies is aggregated and therefore anonymous. If you do not allow these cookies, we cannot know when you visited our website.

These third-party service providers have their own privacy policies addressing how they use such information.
3. Use of Data

We use data that we collect about you or that you provide to us, including any Personal Information, for the following:

Provision and enhancement of our website and products and services:

Provide, enhance, improve, develop, and maintain our website, products and services, and their content;

Provide information you request, and communicate updates, pertaining to our products and services.

Carry out obligations and enforce rights under agreements, including applicable terms of use and this Policy.

Provide customer support and troubleshoot problems.

Provision and Enhancement of our website and products and services. Detect and protect against fraud, malicious, deceptive, or illegal activities.

Ensure internal quality control, debugging, and auditing interactions and transactions.
c.
Resolve disputes and prevent unlawful activities.

Marketing and communication:
a.
Send promotional materials, including updates about events, webinars, and our products and services.
b.
Tailor content and advertisements and conduct direct marketing.
4.
Use of de-identified and aggregated information:
a.
Create and use de-identified or aggregated data for research, internal analysis, analytics, and other legally permissible purposes.

Other purposes:
a.
Fulfill any other purpose for which you provide information.
b.
For any other purpose with your consent, as described at the time of data collection.

As detailed above, we use Personal Information for a variety of business purposes. Our legal basis for collecting and using the Personal Information described above will depend on the Personal Information concerned and the specific context in which we collect it. In general, we rely on the following legal bases for our processing of Personal Information (this includes disclosures of Personal Information, as detailed in Section 4).

To perform a contract with you: we may process Personal Information when necessary to enter or perform a contract for the use of our products and services or otherwise.
2.
Compliance with legal obligations: we may process Personal Information when necessary to comply with legal obligations under applicable laws, including a court order or legal notice.
3.
Consent: we may process Personal Information when you have given us your consent to do so for a particular purpose. You have the right to withdraw your consent at any time by changing your settings (where available) or contacting us through the contact details provided in Section 12.
4.
Legitimate interests: we may process Personal Information where we have a legitimate interest in doing so as the controller. Before doing so, we consider the impact of our processing activities on your fundamental rights and freedoms and make a determination as to whether processing your Personal Information will not adversely impact these rights and freedoms.

Vital interests: we may process your Personal Information where it is necessary in order to protect your vital interests or of another natural person.
6.
Public interests: we may process your Personal Information where it is related to a task that is carried out in the public interest or in the exercise of official authority vested in us.
4. Disclosures of Personal Information
4.1
We may share any Personal Information we collect about you with our:

Service providers: The types of service providers to whom we entrust Personal Information generally include, but are not limited to, service providers for:

The provision of IT and related services. We have contracts in place with our third parties, which are designed to help safeguard your Personal Information. This means that they cannot do anything with your Personal Information unless we have instructed them to do it. They will also not share your Personal Information with any organization apart from us. They also commit to protect the data they hold on our behalf and to retain it for the period we instruct.
b.
Affiliates: We may share Personal Information with our subsidiaries and other affiliated entities. We utilize our affiliates in various parts of the world to provide marketing, products, and services, therefore if you provide consent to be contacted, your data will be shared with our subsidiaries and affiliates.
c.
Business partners: We may provide Personal Information to business partners to provide you with any products and services that you have requested. We may also provide Personal Information to business partners with whom we jointly offer any products and services.
d.
Interest-based or personalized advertising: Through our products and services, we may allow third-party advertising partners to set technologies and other tracking tools to collect information regarding your activities and your device (e.g., your IP address, cookie identifiers, page(s) visited, location, time of day). These advertising partners may use this information (and similar information collected from other services) for purposes of delivering personalized advertisements to you when you visit third-party services within their networks. This practice is commonly referred to as “interest-based advertising” or “personalized advertising” and is conducted under the legal basis of legitimate interest. These cookies are optional and Customers have the right to disable these cookies via our products and services.
e.
Third party products, APIs, and software development kits: We may use third-party products, APIs, and software development kits (“SDKs”) as part of the functionality of our products and services. Third-party products, APIs, and SDKs may allow third parties including advertising partners to collect your Personal Information to provide content that is more relevant to you.
f.
Disclosures to protect us or others: We may access, preserve, and disclose your Personal Information if we believe doing so is required or appropriate to:
i.
Comply with law enforcement or national security requests and legal process, such as a court order or legal notice
ii.
Protect your, our or others’ rights, property, or safety
iii.
Collect amounts owed to us
iv.
When we believe disclosure is necessary or appropriate to prevent financial loss or in connection with an investigation or prosecution of suspected or actual illegal activity
v.
If we, in good faith, believe that disclosure is otherwise necessary or advisable
g.
Merger, sale, or other asset transfers: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider, whether actual or potential (as the case may be), then your information may be sold or transferred as part of such a transaction as permitted by law and/or contract.
5. Data Collected by Unaffiliated Third Parties
Our products and services may link to third-party websites, online services, or mobile applications and/or contain advertisements from third parties that are not affiliated with us and which may link to other websites, services, or applications. Accordingly, we do not make any guarantee regarding any such third parties, and we will not be liable for any loss or damage caused by the use of such third-party websites, services, or applications. The inclusion of a link towards a third-party website, service, or application does not imply an endorsement by us. We cannot guarantee the safety and privacy of data you provide to any third parties. Any data collected by third parties is not covered by this Policy. We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services, or applications that may be linked to or from our products and services. You should review the policies of such third parties and contact them directly to respond to your questions.
6. International Transfers
Our data, including Personal Information, may be processed at our operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to, and maintained on, computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those from your jurisdiction, and data may be accessible to law enforcement and national security authorities under certain circumstances. By using our products and services, or providing us with any information, you consent to the collection, processing, maintenance, and transfer of such information in and to the applicable countries in which the privacy laws may not be as comprehensive as, or equivalent to, those in the country where you reside or are a citizen. We, nevertheless, endeavor to transfer your Personal Information to any other jurisdictions consistent with the requirements of applicable laws.
7. Retention
We retain the Personal Information we receive as described in this Policy for as long as you use our products and services or as necessary to fulfill the purpose(s) for which it was collected, provide our products and services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.
When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize such information, or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible.
8. Security
The security of your Personal Information is important to us, and we strive to implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information we store in order to protect it from unauthorized access, destruction, use, modification, or disclosure.
However, please be aware that no method of transmission over the internet, or method of electronic storage, is 100% secure, and third parties may unlawfully intercept or access transmissions or private communications. We are unable to guarantee the absolute security of your information or that your information or private communications will always remain private. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of information at any time. Any transmission of information is at your own risk, and we are not responsible for the circumvention of any security measures implemented on within our products and services.
The safety and security of your information also depend on you. Information provided through your creation and use of an account (if any) is protected by a password for your privacy and security, and you are responsible for keeping this password confidential. It is important that you prevent unauthorized access to your account and information by using a unique, secure, and protected password and limiting access to your password.
Any breach of your privacy will be notified to you, and dealt with, in accordance with applicable laws.
9. Children's Privacy
We do not knowingly solicit data from or market to children under eighteen (18)years of age. By using our products and services, you represent that you are at least eighteen (18) years of age. If we learn that Personal Information from users less than eighteen (18) years of age has been collected, we will de activate the account (if any) and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age eighteen (18), please contact us using the contact details provided in Section 12.
10. Your Privacy Rights
10.1
You may have the following rights as regards your privacy according to applicable laws:
a.
Right to access: the right to obtain access to your information (if we’re processing it), and certain other information;
b.
Right to correct: if your Personal Information is in accurate or incomplete you may have the right to have your Personal Information rectified;
c.
Right to erasure: this is also known as ‘the right to be forgotten’ and, in simple terms, enables you to request the deletion or removal of your information where there’s no compelling reason for us to keep using it. This is not a general right to erasure; there are exceptions. For example, we have the right to continue using your Personal Information if such use is necessary for compliance with our legal obligations or for the establishment, exercise or defense of legal claims;
d.
Right to restriction of processing: the right to suspend the usage of your Personal Information or limit the way in which we can process it. Please note that this right is limited in certain situations. When we are processing your Personal Information that we collected from you with your consent you can only request restriction on the basis of:
i.
Inaccuracy of data;
ii.
Where our processing is unlawful and you don’t want your Personal Information erased;
iii.
You need it for a legal claim; or
iv.
If we no longer need to use the data for the purposes for which we hold it. When processing is restricted, we can still store your information, but may not use it further. We keep lists of people who have asked for restriction of the use of their Personal Information to make sure the restriction is respected in future;

Right to data portability: the right to request that we move, copy or transfer (where technically feasible) your Personal Information in a structured, commonly used and machine-readable format, for your own purposes across different services;

Right to object: the right to object to our processing of your Personal Information including where we process it for our legitimate interests, direct marketing;

Right to nominate: the right to nominate an individual to exercise your privacy rights under applicable laws in the event of your death or disability;

Right to withdraw consent: if we are relying on your consent to process your Personal Information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in Section 12 or updating your preferences.
However, please note that this will not affect the lawfulness of the processing before its withdrawal, nor when applicable law allows, will it affect the processing of your Personal Information conducted in reliance on lawful processing grounds other than consent.
You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, replying “STOP” or “UNSUBSCRIBE” to the SMS messages that we send, or by contacting us using the details provided in Section 12. You will then be removed from the marketing lists, however, we may still communicate with you, for example to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes;
i.
Right to lodge a complaint: You have the right to lodge a complaint with us about our processing of your Personal Information by contacting us through the contact details provided in Section 12. You may also lodge a complaint with a supervisory authority, in particular in the jurisdiction of your habitual residence, place of work or place of the alleged infringement. However, we encourage you to contact us first, and we will do our best to resolve your concern.
j.
Merger, sale, or other asset transfers: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider, whether actual or potential (as the case may be), then your information may be sold or transferred as part of such a transaction as permitted by law and/or contract.
11. Updates to this Policy
We may update this Policy from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this Policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this Policy frequently to be informed of how we are protecting your information.
